In most cases we deliver products using our own delivery service, but we reserve the right to choose another delivery service if this allows the order to be fulfilled more efficiently.<\/p><p>Delivery is completely safe and, for all purchases, is only possible to an address in Slovenia.<\/p><p>For purchases from outside Slovenia, the goods may be collected in person at the provider\u2019s address.<\/p><p>The risk of loss of or damage to the dispatched goods passes from the provider to the buyer when the buyer, or a third party other than the carrier designated by the buyer for that purpose, takes physical possession of the goods. Legal guarantee of conformity of goods<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-51d0541 elementor-widget elementor-widget-text-editor\" data-id=\"51d0541\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The provider is liable for any lack of conformity of the goods which exists at the time the goods are delivered and which becomes apparent within two years of delivery of the goods. Any lack of conformity which becomes apparent within one year of delivery of the goods is presumed to have existed at the time of delivery, unless the provider proves otherwise or unless this presumption is incompatible with the nature of the goods or the nature of the lack of conformity. The consumer may exercise their rights under the legal guarantee of conformity if they notify the seller of the lack of conformity within two (2) months of discovering it. In the notification of the lack of conformity, the consumer must describe the lack of conformity precisely and allow the seller to inspect the goods. The notification of the lack of conformity must be accompanied by the invoice, contract or other document confirming the purchase. The consumer may send the notification of the lack of conformity to <a href=\"mailto:narocila@rastlinjaki-gajsek.si\">narocila@rastlinjaki-gajsek.si<\/a> or submit it in person at the address: Rastlinjaki Gaj\u0161ek d.o.o., Ljubljanska cesta 37, 2310 Slovenska Bistrica<\/p><p>The goods are in conformity with the sales contract in particular where, as applicable (subjective requirements for conformity of goods), they:<\/p><ul><li>correspond to the description, type, quantity and quality, and possess the functionality, compatibility, interoperability and other features, as required by the sales contract;<\/li><li>are fit for any particular purpose for which the consumer requires them and which the consumer made known to the seller at the latest at the time of conclusion of the sales contract, and in respect of which the provider has given its acceptance;<\/li><li>are delivered with all accessories and instructions, including on installation, as stipulated by the sales contract; and<\/li><li>are supplied with updates as stipulated by the sales contract.<\/li><\/ul><p><br>In addition to complying with the requirements set out in the previous paragraph (subjective requirements for conformity of goods), the goods must also (objective requirements for conformity of goods):<\/p><ul><li>be fit for the purposes for which goods of the same type would normally be used, taking into account, where applicable, any other regulations, technical standards or, in the absence of such technical standards, applicable sector-specific industry codes of conduct;<\/li><li>where applicable, be of the quality of and correspond to the description of a sample or model that the provider made available to the consumer before the conclusion of the sales contract;<\/li><li>where applicable, be delivered along with such accessories, including packaging, installation instructions or other instructions, as the consumer may reasonably expect to receive; and<\/li><li>be of the quantity and possess the qualities and other features, including in relation to durability, functionality, compatibility and safety, normal for goods of the same type and which the consumer may reasonably expect given the nature of the goods and taking into account any public statement made by or on behalf of the seller, or other persons in previous links of the chain of transactions, including the producer, particularly in advertising or on labelling, unless the provider shows that:<ul><li>it was not, and could not reasonably have been, aware of the public statement in question,<\/li><li>by the time of conclusion of the sales contract, the public statement had been corrected in the same way as, or in a way comparable to how, it had been made, or<\/li><li>the decision to buy the goods could not have been influenced by the public statement.<\/li><\/ul><\/li><\/ul><p><br>The provider is not liable for a lack of conformity of the goods if, at the time of conclusion of the contract, the consumer was specifically informed that a particular characteristic of the goods deviated from the objective requirements for conformity laid down in the applicable consumer protection legislation, and the consumer expressly and separately accepted that deviation when concluding the contract.<\/p><p>The consumer may require the seller to bring the goods into conformity free of charge, within a reasonable period of time from the moment the consumer informed the seller of the lack of conformity, which shall not exceed 30 days, and without any significant inconvenience to the consumer, taking into account in particular the nature of the goods and the purpose for which the consumer required the goods. This period may be extended by the shortest time necessary to complete the repair or replacement, but by no more than 15 days, in which case the provider will inform the consumer of the number of days of the extension and the reasons for it before the 30-day period expires.<\/p><p>A consumer who has duly notified the seller of a lack of conformity may require the following from the seller, in the order set out below:<\/p><ol><li>that the goods be brought into conformity free of charge (repair or replacement);<\/li><li>a price reduction proportionate to the lack of conformity, or termination of the sales contract and reimbursement of the amount paid.<\/li><\/ol><p><br>If the existence of a lack of conformity of the goods is disputed, the provider will notify the consumer thereof in writing within eight days of receiving the consumer\u2019s claim under the guarantee.<\/p><p>If the lack of conformity became apparent less than 30 days after delivery of the goods, the consumer may withdraw from the contract. Withdrawal from the contract may be made by means of the statement attached to these terms and conditions. Where the consumer withdraws from the sales contract, the provider will reimburse the consumer the amount paid without delay, and at the latest within eight days of receiving the goods or proof that the consumer has sent the goods back. The purchase price will be refunded to the consumer using the same means of payment as the consumer used for the payment.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9467c64 elementor-widget elementor-widget-heading\" data-id=\"9467c64\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">8. Returning a product<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cae9e0c elementor-widget elementor-widget-text-editor\" data-id=\"cae9e0c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>In the case of distance contracts, the consumer has the right to notify the trader, within 14 days of receiving the goods, that they are withdrawing from the contract, without having to give any reason for their decision. The consumer must return the goods within 14 days of notifying their intention to withdraw from the contract. The only cost borne by the consumer in connection with withdrawal from the contract is the direct cost of returning the goods.<\/p><p>In the case of a sales contract, the withdrawal period referred to in the previous paragraph begins on the day on which:<\/p><ul><li>the consumer, or a third party other than the carrier designated by the consumer, acquires physical possession of the goods,<\/li><li>the consumer, or a third party other than the carrier designated by the consumer, acquires physical possession of the last item of goods, where the contract covers multiple items of goods ordered by the consumer in one order,<\/li><li>the consumer, or a third party other than the carrier designated by the consumer, acquires physical possession of the last lot or piece of goods, where the goods are delivered in multiple lots or pieces,<\/li><li>the consumer, or a third party other than the carrier designated by the consumer, acquires physical possession of the first item of goods, where goods are delivered regularly during a defined period.<\/li><\/ul><p><br>In the case of a service contract, the withdrawal period referred to in the first paragraph of this article begins on the day the contract is concluded.<\/p><p>Unless the contracting parties have agreed otherwise, the consumer does not have the right of withdrawal referred to in the first paragraph of this article in the case of contracts:<\/p><ul><li>for goods or services whose price depends on fluctuations in the market which the trader cannot control and which may occur within the withdrawal period;<\/li><li>for goods made to the consumer\u2019s specifications or clearly personalised to their personal needs;<\/li><li>for services, after the service has been fully performed by the trader, if performance began with the consumer\u2019s express prior consent and with the acknowledgement that they will lose their right of withdrawal once the contract has been fully performed by the trader;<\/li><li>for the supply of goods which, by their nature, are inseparably mixed with other items;<\/li><li>concluded at public auctions;<\/li><li>where the consumer has specifically requested a visit from the trader at their home for the purpose of carrying out urgent repairs or maintenance. If, on such a visit, the trader provides additional services which the consumer did not specifically request, or supplies goods other than replacement parts necessarily used in carrying out the maintenance or repairs, the consumer has the right of withdrawal in respect of those additional services or goods.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-480f4ba elementor-widget elementor-widget-heading\" data-id=\"480f4ba\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">9. Complaints and disputes<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-526544c elementor-widget elementor-widget-text-editor\" data-id=\"526544c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The provider complies with the applicable consumer protection legislation.<\/p><p>In the event of complaints, disputes or problems, the consumer may contact the provider by telephone on 08 200 08 10 or by email at <a href=\"mailto:narocila@rastlinjaki-gajsek.si\">narocila@rastlinjaki-gajsek.si<\/a>. Complaints are submitted via the email address <a href=\"mailto:narocila@rastlinjaki-gajsek.si\">narocila@rastlinjaki-gajsek.si<\/a>. The complaints procedure is confidential.<\/p><p>The provider responds to all complaints by email or telephone as soon as possible and within its statutory obligations, depending on the type of complaint.<\/p><p>The provider is aware that an essential characteristic of consumer disputes, at least as far as resolution by the courts is concerned, is the disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main reason why consumers do not bring disputes before the courts. The provider therefore makes every effort to resolve any disputes amicably.<\/p><p>If a dispute cannot be resolved, the court competent to resolve it is the court of the consumer\u2019s place of permanent residence.<\/p><p>On 14 November 2015, the Out-of-Court Settlement of Consumer Disputes Act (Official Gazette of the Republic of Slovenia, No. 81\/2015; hereinafter: ZIsRPS) entered into force. The ZIsRPS governs the out-of-court settlement of domestic and cross-border disputes between businesses and consumers through an out-of-court consumer dispute resolution provider (hereinafter: ADR provider).<\/p><p>In accordance with the statutory provisions, the provider does not recognise any out-of-court consumer dispute resolution provider as competent to resolve a consumer dispute which the consumer could initiate under the Out-of-Court Settlement of Consumer Disputes Act.<\/p><p>The provider operates its online shop in the territory of the Republic of Slovenia and publishes an electronic link to the <a href=\"https:\/\/consumer-redress.ec.europa.eu\/index_sl\" target=\"_blank\" rel=\"noopener\">platform for online dispute resolution of consumer disputes (ODR)<\/a>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5c2b140 elementor-widget elementor-widget-heading\" data-id=\"5c2b140\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">10.
